Terms of Service

These Terms of Service govern your use of Profitly — including Free & Pro plans, trials, subscriptions, billing, online stores, and seller responsibilities. By creating an account or using Profitly, you agree to the following terms.
1. The service
Profitly provides seller tools: COGS calculators, products, leads, orders, customers, documents (invoices/quotations), reports, simple finance, inventory, suppliers, purchases, dashboard, online stores, and related features.
Profitly is an operational tool. We are not a financial institution, licensed tax advisor, marketplace, or party to transactions between you and your customers.
2. Subscription plans
Profitly offers:
- Free — no charge with usage limits, including up to 3 active products.
- Pro — monthly or yearly subscription with full features and unlimited products.
- Trial — 14-day Pro access for eligible new users (not a separate plan).
3. Free trial
The Pro free trial can be used once per account for 14 days, with no credit card required.
A trial is not a permanent right. Profitly may stop or deny trials for abuse, suspicious activity, or terms violations.
After the trial ends without an active subscription, your account returns to Free. Your business data is kept and not deleted.
4. Subscription payment
Pro subscriptions are paid through official payment gateways integrated with Profitly.
Prices may change over time. Price changes do not affect billing periods already paid and in progress.
Current pricing is shown on the pricing page and in the in-app Billing Center.
5. Cancel subscription
You may cancel your Pro subscription anytime in the Billing Center.
No refunds for the remaining paid period.
Your subscription stays active until the end of the current billing period. After that, your account becomes Free.
You may reactivate before the period ends if reactivation is available and within the allowed window.
6. Refund
Refunds are generally not available for Profitly subscriptions.
Refunds are provided only where required by applicable law in your jurisdiction.
7. Free plan
The Free plan has usage limits, including up to 3 active products.
When limits are reached, you may upgrade to Pro to add more products and unlock advanced features.
Products beyond the Free limit may remain stored but cannot be edited or added until you upgrade.
8. Data and retention
Profitly does not delete your business data when you downgrade to Free or cancel a subscription.
Certain features are available only on your active plan. Downgrading does not remove orders, customers, invoices, or historical data.
9. Account eligibility
You must provide accurate account information and keep login credentials secure. You are responsible for all activity under your account.
You represent that you have legal capacity to use this service under applicable law.
10. Permitted use
You agree to use Profitly for lawful business purposes, including:
- Recording products, costs, orders, and customers.
- Creating sales documents and sharing payment instructions with customers.
- Operating a public online store per your settings.
- Managing Profitly subscriptions and billing in the Billing Center.
- Using optional integrations such as Telegram notifications.
11. Prohibited conduct
You must not:
- Use Profitly for illegal activity, fraud, or infringement of third-party rights.
- Upload unlawful, misleading, or copyright/trademark-violating content.
- Abuse trials, coupons, or the billing system.
- Access other users' data or disrupt system security.
- Abuse public features (online store, tracking pages) for spam.
12. Online store (storefront)
If you enable an online store, you are fully responsible for all published products — names, photos, descriptions, prices, availability, shipping policies, and buyer communication.
Profitly provides store infrastructure; the sales contract is directly between you and your customer.
13. Customer payments
Profitly is not responsible for payment transactions between you and your business customers.
Customer payments go directly to you — not through Profitly. Profitly is not escrow and does not hold buyer funds.
You must comply with consumer protection, tax, and trade regulations applicable to your business.
14. Seller content
You are responsible for content you upload and publish:
- Products — accurate names, prices, and availability.
- Photos — right to use uploaded images.
- Descriptions — not misleading or unlawful.
- Prices — consistent with your business policy and applicable rules.
15. Account suspension
Profitly may suspend or terminate access if there is:
- Spam or abuse of public features.
- Fraud or billing/trial manipulation.
- Service abuse harming other users or the system.
- Illegal activity or violation of these terms.
16. Finance, tax, and disclaimer
Finance and tax features are assistive and estimative — not professional accounting or tax advice.
You are responsible for verifying figures, filing taxes, and meeting legal business obligations.
17. Limitation of liability
To the extent permitted by law, Profitly is not liable for indirect losses, lost profits, or damages from transactions between you and customers.
Profitly's total liability for service-related claims is limited under applicable law.
18. Service changes
Profitly may add, update, or change features over time — including plans, Free limits, and payment gateway integrations.
Material changes will be communicated via the app, email, or website. We strive for availability but do not guarantee uninterrupted access.
19. Changes to terms
We may update these Terms of Service. The latest version is published on this page with an updated date. Continued use after changes means you accept the updated terms.
20. Governing law
These terms are governed by the laws of the Republic of Indonesia, without prejudice to mandatory consumer rights under local law.
